WARRANTY TERMS AND CONDITIONS

WARRANTY COVERAGE AND EXCLUSIONS

  1. Subject to the limitations set forth in this Terms and Conditions, the Warranty covers defects on the Covered Vehicle caused primarily by a part listed in the “List of Parts Covered by Warranty”, which is attached to the Warranty Agreement as Annex “A” (the “List of Covered Parts”).

  2. The Warranty shall have a Maximum Accumulated Repair Cost and Maximum One Time Repair Cost as specified in the Warranty Agreement.

    (a) “Maximum Accumulated Repair Cost” shall mean the maximum repair cost to be covered by the Warranty accumulated throughout the covered period.

    (b) “Maximum One-Time Repair Cost” shall mean the maximum repair cost to be covered by the Warranty during any one-time claim.

  3. The Warranty excludes defects that had already occurred and were recognized at the time of delivery of the vehicle.

  4. The Warranty shall not apply to issues or defects corresponding to the following:

    (a) Issues occurring due to aging of the vehicle, such as, but not limited to: natural discoloration of painted surfaces, plated surfaces, interior parts, or resin parts, deterioration, corrosion, rust, yellowing of lenses, fogging, changes in vehicle height or inclination, and other changes of similar nature.

    (b) Issues that do not affect the functioning or running of the vehicle, such as but not limited to: abnormal noises, vibrations, oil leaks, smells, or similar issues.

    (c) Issues related to appearance, such as, but not limited to: bulging, balding, peeling, misalignment, bending, cracking, and similar issues.

    (d) Any vehicle deterioration as a result of negligence or prolonged storage which could have been identified and remedied with proper vehicle care and/or standard maintenance.

    (e) Any condition resulting from misuse or use beyond the limitations or intended purposes of the Covered Vehicle, whether intentionally, by error, or neglect

    (f) Issues resulting from the way the car was driven or issues for which there is insufficient criteria for determining whether there is a defect, such as, but not limited to: high oil consumption, poor fuel-efficiency, insufficient power, stiff or harsh handling, tire slippage or misalignment or adjustment of alignment, vehicle instability, and other similar issues.

    (g) Defects when using the vehicle at a speed that exceeds the legal speed, at a load exceeding the legal load limit, or at a capacity that exceeds the legal riding capacity.

    (h) Issues which cannot be identified or replicated when delivered to an accredited auto repair shop

    (i) Defects that could have been discovered and addressed through normal care but worsened due to neglect.

    (j) Issues or defects arising in vehicles used outside of Philippines.

    (k) Any breakdown resulting from the use of unauthorized parts, accessories, or fluids not specified or recommended by the vehicle manufacturer.

    (l) Failure of modified parts in the event modified parts have been attached.

    (m) Any breakdown resulting from any modification of parts that affects the performance or function of the Covered Vehicle if such parts had been fitted.

    (n) Any breakdown or defects which occurs during delivery of the Covered Vehicle to the Buyer.

  5. The Buyer may not apply for a warranty for vehicles set forth in the “Definition of Repaired Vehicle”, which shall mean any vehicle wherein the following critical body components have been replaced or repaired, or such replacement or repairs were physically identified; side member or frame, cross member, front inside body panel, front/center/rear pillar, dash body panel, roof body panel, floor body panel, trunk floor body panel, or radiator core support panel.

    (a) Parts not listed in the List of Covered Parts.

    (b) Parts other than the parts attached to the Covered Vehicle by the vehicle manufacturer (parts from other companies, genuine carryover parts, etc.).

    (c) Modified parts which were fitted by the vehicle manufacturer and/or the Dealer

    (d) Unauthorized modified or altered parts and/or any components which were fitted by the Buyer, a Dealer, or the Covered Vehicle’s former owner(s).

    (e) Refurbished parts and all mechanisms that involve such refurbished parts.

    (f) Any vehicle that has been used for commercial purposes, including but not limited to taxi, rental, or transport network vehicle service (TNVS).

    (g) Any vehicle that has been used for competitions, such as races and rallies, pace making, reliability trail, speed testing.

    (h) Any vehicle that has been used on rough roads, such as forest roads.

    (i) Any vehicle that has been used for commercial purposes, including but not limited to taxi, rental, or transport network vehicle service (TNVS).

    (j) Any vehicle that has been used for competitions, such as races and rallies, pace making, reliability trail, speed testing.

    (k) Any vehicle that has been used on rough roads, such as forest roads.

  6. The Warranty shall not apply to defects caused by any of the following items.

    (a) Failure to conduct daily inspections and maintenance (including inspections before high-speed travel), periodic inspections and maintenance prescribed by laws and regulations, or periodic inspections and maintenance described in the vehicle manufacturer’s inspection and/or maintenance record book or similar document.

    (b) Inadequate or faulty inspection or maintenance.

    (c) Negligence during inspection or maintenance work.

    (d) Failure to replace regular replacement parts specified by the vehicle manufacturer as specified.

    (e) Modifications, such as modification of vehicle height and engine tune-ups, etc.

    (f) Installation of parts other than those to be attached to the vehicle as specified by the vehicle manufacturer.

    (g) Use of the Covered Vehicle for competitions, such as races and rallies, pace making, reliability trail, speed testing.

    (h) Regular use of the Covered Vehicle on rough roads, such as forest roads.

    (i) Use of the Covered Vehicle for commercial purposes including but not limited to as a taxi, rental unit, or Transport Network Vehicle Service (TNVS),

    (j) Failure to observe the riding capacity, loading capacity, legal speed, and other matters stipulated by laws and regulations.

    (k) Accidents and other occurrences such as, but not limited to, mischief, theft, vandalism, fire, collision, riot.

    (l) Natural disasters, such as earthquakes, typhoons, floods, volcanic eruptions.

    (m) Falling objects such as, but not limited to construction tools and equipment, greenery, airplane components, and other materials.

    (n) Use of oils and parts other than those specified by the vehicle manufacturer.

    (o) External factors, such as smoke, chemicals, bird droppings, flying rocks or stones, acid rain, salt damage, etc.

    (p) Vehicle repair (including repairs made by the former owner(s) and those prior to contract, etc.).

    (q) Damage or accidents due to collision or contact (including those by the former owner(s) and those prior to contract, etc.).

    (r) Defects caused by the intentional or negligent conduct of the Buyer.

  7. The Buyer may not apply for a warranty for vehicles that fall under the definition of “Modified Vehicle”, which shall mean that:

    (a) The following parts and/or components of the Covered Vehicle have been replaced or altered with those manufactured by other than the vehicle manufacturer, or such replacement or installation was physically identified: electric fuel controller module, turbocharger/supercharger boost control module, turbocharger intercooler, fuel injector, turbocharger waste-gate valve, turbocharger turbine, carburetor, engine camshaft, engine camshaft pulley, engine control unit, anti-roll bar, air suspension, or air suspension controller.

    (b) The following modifications have been made, or such modification was physically identified on the Covered Vehicle: hydraulic suspension, roof higher than original, vehicle height higher or lower than original, transmission gear shift, or engine bore up.

    (c) The Covered Vehicle had modifications that violate existing government laws, rules, or regulations

  8. The Buyer may not apply for a warranty for vehicles set forth in the “Definition of Repaired Vehicle”, which shall mean any vehicle wherein the following critical body components have been replaced or repaired, or such replacement or repairs were physically identified; side member or frame, cross member, front inside body panel, front/center/rear pillar, dash body panel, roof body panel, floor body panel, trunk floor body panel, or radiator core support panel.

DETERMINATION AND SCOPE OF COVERAGE OF WARRANTY

  1. The determination of the application of the Warranty shall be based on whether or not the part that is the primary cause of the defect conforms to the contents of the List of Covered Parts.

  2. In the event multiple parts give rise to a defect and it is determined that the defect is due to a series of such parts, even if such parts are listed in the List of Covered Parts, the Warranty shall not apply in the event that the parts that are the primary cause of the defect are not listed in the List of Covered Parts, and the Warranty shall not apply with respect to the parts listed on the List of Covered Parts.

  3. The scope of the Warranty shall be limited to the cost of the parts that are the primary cause of the defect and the labor required for replacement of the same.

  4. In the event the Warranty applies to the parts that are the primary cause of the defect, the Warranty shall not apply to the parts that are not defective but are recommended to be replaced in connection therewith.

Ex.: In the event a defect appears in one-wheel hub bearing and no other parts are defective but the simultaneous replacement of other non-defective wheel hub bearing is recommended by the accredited repair shop, the other wheel hub bearing that is non-defective at the time of assessment shall fall outside of Warranty coverage.

WARRANTY PROCESS

  1. In the event the Buyer desires to make a claim under the Warranty, he/she shall, within seven (7) days from the date of the breakdown, seek the endorsement of PWSPI, who shall advise the Buyer to deliver the Covered Vehicle to a specific maintenance/repair shop.

  2. In the event the Buyer requests repair of a vehicle pursuant to the Warranty, PWSPI may request that the Buyer present its identification card, latest Land Transportation Office (LTO) Official Receipt and Certificate of Registration of the Covered Vehicle, inspection report, warranty certificate, authorization letter, if applicable, maintenance records book, and such other documents as may be necessary for the proper assessment of the defects or damage to the Covered Vehicle.

  3. PWSPI shall not be liable for any costs or expenses that are not directly related to the repair of the defect or losses and/or opportunity loss that may arise as a result of the Buyer’s inability to use the Covered Vehicle, as well as inspection costs, quotation fee, diagnosis fee, estimated costs, fault diagnosis costs, waste disposal costs, vehicle replacement costs, rental car costs, tow truck costs, transportation costs, compensation for operating losses, and other costs of similar nature.

  4. The Warranty shall not apply in the event the Buyer makes an order for repair, makes arrangements for parts, or instructs a repair shop to commence repair work without obtaining the prior endorsement of PWSPI, and PWSPI shall not be liable for any of the costs or expenses related thereto, even if the costs or expenses would have otherwise been covered under the Warranty.

PARTS REPLACEMENT

  1. PWSPI is not bound to use new original equipment manufactured (OEM) parts to replace the covered parts and may use any commercially distributed aftermarket parts manufactured by designated suppliers of the vehicle manufacturer. If the foregoing options are not available, the PWSPI may also use secondhand or recycled parts such as remanufactured parts processed by original parts manufacturers or by any entity designated by such manufacturers, rebuilt or half-rebuilt parts processed by any entity other than such manufacturers. PWSPI shall have the sole discretion in the procurement of parts.

  2. The Buyer may not designate any grade, brand, or manufacturer of lubricants, fluids, and/or parts.

  3. In the event that the Buyer elects to provide any parts to replace the covered parts, PWSPI shall not make any refund and will not be liable for any subsequent breakdown caused by such parts.

  4. The Warranty shall not cover any parts that cannot be sourced by the accredited auto repair shop or PWSPI, such as when the parts are no longer in production. PWSPI may exercise the option to pay the latest price issued by the vehicle manufacturer plus a reasonable labor cost to replace such part to the Buyer.

  5. PWSPI shall have the right to collect replaced parts covered by the Warranty.

  6. In the event that the covered part is recommended by the accredited repair shop to be replaced in pairs or as a set, the Warranty shall not cover the replacement cost of the non-broken parts. (ex. If only one (1) broken shock absorber is covered, the Warranty shall not cover the replacement of the other three (3) non-broken shock absorbers.)

TERMINATION OF THE WARRANTY AGREEMENT

  1. In the event PWSPI determines that any of the following exist, this Agreement is automatically terminated, and the Warranty shall cease to be applicable.

    (a) In the event PWSPI determines that the Buyer has misused the Warranty.

    (b) In the event the Covered Vehicle becomes a “Modified Vehicle” as set forth in Part A(7) of this Terms and Conditions after enrolling for the Warranty.

    (c) In the event the Covered Vehicle becomes a “Repaired Vehicle” as set forth in Part A(8) of this Terms and Conditions after enrolling in the Warranty.

    (d) In the event the registered use of the Covered Vehicle is changed to business use after enrolling in the Warranty.

    (e) In the event it is discovered after enrolling in the Warranty that the Buyer is an employee of PWSPI, a representative of PWSPI, or a relative no more than two degrees removed (consanguinity or affinity) from a representative of PWSPI.

    (f) In the event it is discovered that the party contracting for the Warranty is/was a criminal organization, a member of a criminal organization, an associated member of a criminal organization, a company affiliated with a criminal organization, or other party analogous to the foregoing.

  2. PWSPI shall not return the warranty fee or pay any other money in connection with the early termination for any reason.

NON-TRANSFERABILITY

  1. The Buyer may not transfer its rights under the Warranty (hereinafter referred to as the “Beneficial Interest”) to a third party.

  2. The Beneficial Interest shall be automatically extinguished when the person possessing the Beneficial Interest is neither a user nor the registered owner of the Covered Vehicle covered by the Warranty.

OTHER TERMS AND CONDITIONS

  1. The Buyer shall notify PWSPI without delay if there is any change in the items set forth on the warranty certificate (address, contact information, etc.) after receipt of the warranty certificate from PWSPI.

  2. PWSPI may subcontract its obligations under this Agreement without the prior consent of the Buyer. The Buyer agrees and hereby gives its consent for the sharing of any relevant data needed to service the Warranty to any third-party service provider, including any personal information it has disclosed to a Dealer or PWSPI. For this purpose, the Buyer shall sign the data privacy consent form provided to it by PWSPI.
